Commons Creativity

Larry Lessig offers one more blog entry before Howard the Dean steps in as a guest blogger for a week. Lessig points to a guitar track Coliln Mutchler posted to Opsound under a Creative Commons license that allows it to be shared so long as attribution is given. Cora Beth, a 17-year-old violinist then added a violin track, resulting in this.

Stuff like this enriches the world the way that that owned and defended music just can't.

I disagree. I think a rational system for derivative works would allow such creativity, without disclaiming all possibility of payment.
The model is very simple - you can create a derivative work without having to negotiate rights, provided only that people who pay the price for your work also pay the price for the source work you derived it from.
If they have already paid, they don't need to pay again.
