Hoder & Canadian blogs

After Hoder's blog was held against him by American Immigration, Canadian Brent Ashley holds it against him in a "Canada: Blog it or leave it!" sort of way.

Michael O'Connor Clarke blogs a paper by Howard Levitt on how Canadian employment law applies to blogging. For example:

Whereas internet use and email use from a personal email account which is done after work hours on a personal computer may not form the basis of a harassment claim because of the reasonable expectation of privacy that exists, because a blog is in the public domain, harassing blog entries made on a person computer, outside of company time, and not using company resources, may still have the potential to result in disciplinary action because they have the potential to create a hostile work environment as there is greater potential that co-workers and management will encounter the harassing material.

Howard isn't necessarily recommending this; he's trying to anticipate how court decisions might go. His recommended (and generally quite reasonable) corporate policy on blogging, however, seems to apply also to blogs created or viewed at home, on one's own time, and includes a prohibition on viewing blogs that contain "inappropriate or offensive material." Does he really think that that's a reasonable or enforceable proposal? Or am I misunderstanding him? [Tags: hoder canada MichaelOConnorClarke BrentAshley]

as I clarify in a followup post, I don't want him to leave, I want him to stay and appreciate his Canadian citizenship for all the benefits it affords him, not just to use it like a mailorder college degree.

I suspect what Howard Levitt (a well-known employment-law lawyer in Toronto) was getting at in his advice about blogging is that even blogging from home on your own computer may come to the attention of your boss and co-employees, and you could create a poisoned work environment by showing yourself to be a racist/fascist/whatever-is-really-unacceptable-to-your-co-workers, so they're uncomfortable having you around.

I don't think there is any way that what a person looks at on his/her own home computer can poison the work environment. It's what a person puts on the Web that co-workers can readily access that may affect the person's employment.

As David W said, it's advice, not a statement of an ideal world. And some employers and co-workers are much more accepting of diverse views and lifestyles than others. Know your workplace before doing things that mess with it - and be aware that what you do at home can mess with your workplace. A counsel of prudence.

hi my wife is fighting liver cancer and was getting treatment up until thru of this week
then the doctor stop all treatment and she is not able to get kemo ,he knew she didnt have ohip but still took her case .this isnt right everyone should have the help they need cant get her ohip card without her landing papers .does that mean she has to die no l dont think so

should doctors play GOD no because there is only one god,we live three hours pass the sault doctors here are a jock my wife started feeling sick in june of o6 and it took to dec06 to get her a specailist in the sault they kept saying she didnt need a specailist how wrong they where
she had colon surgery febo7 the doctor was great
but when it comes to the liver part thats a different story she is in stage four and doctor will not give her the treatment she needs to save
her life PLAYING GOD not right
